GENERAL CONDITIONS OF THE PURCHASE CONTRACT AT WRITING-PENS.COM
The general conditions indicated in this document regulate solely and exclusively the purchase and sale of fountain pens, ballpoint pens, mechanical pencils, rollerballs, inks, accessories and related products (hereinafter “the fountain pens ”) offered by Publinspira S.L. (hereinafter "writing-pens.com") through its website writing-pens.com
The Legal Notice published on this web page identifies the owner of the website. Similarly, said Legal Notice contains information on the personal data protection policy developed by Publinspira S.L.
The fountain pens offered on this website are intended for private consumption, so their acquisition is subject to the conditions referred to in the sales contract.
It will be understood that the access, the purchase of products or the mere use of the Online Store by the user implies the full adherence, and without reservations, of the user to each and every one of the General Conditions that Publinspira, S.L. have published each time the user accesses the Online Store.
Each order placed in the Online Store is governed by the general conditions applicable to the date of the order.
The sales contract is considered perfected at the time the customer issues the express confirmation of their order, and when Publinspira expressly agrees, for which it will be necessary to previously accept the general conditions indicated. For this reason, Publinspira S.L. recommends to its clients the full reading of both the legal notice published on this website and the general conditions in which characteristics, price, form and shipping times, return policy and payment method are specified before issuing the acceptance that formalizes the order of the products and perfect the contract by the general conditions applicable to the date of the order.
Once the selling party and the object of the sale have been identified in the current catalog on the website, and with reference to the information on the characteristics and price of each item contained in its corresponding file, this contract is entered into in accordance with the following conditions:
FIRST: Methods of payment
This contract is perfected and binds the parties in terms of the obligation to deliver the goods by the seller and the payment of the price established by the buyer from the moment of its acceptance by the latter.
The full payment of the price of the fountain pens, which appears on the corresponding tab of each one of them, will be made by one of the methods indicated below, being the choice of one or another form of payment recognized faculty of the buyer. 1. Payment of the fountain pens by credit or debit card.

2. Payment of the fountain pens by bank transfer.
The customer will make a bank transfer for the total of the operation to the account that the seller has indicated. For this form of payment to be considered valid, Publinspirá must have received the entire amount corresponding to the order in the indicated account. If after a period of 7 calendar days the transfer has not been made effective in the seller's account, the order for the fountain pens may be canceled by the latter and the contract will be terminated. shall be deemed resolved and without effect for any of the parties.
The client must indicate the following information in the transfer:
- Name of the natural or legal person to whom the order of the products must be invoiced, also indicating the billing information (DNI, NIF, billing address) If the delivery address is different from the billing address, it must be sent explicitly (receiver's name, delivery address, Postal Code, town, state and contact telephone number).
- Order number, automatically assigned by the system at the end of the purchase process.
- Indicate as beneficiary of the transfer to Publinspira.S.L.
3. PayPal. The Paypal platform allows you to pay quickly and securely with your Paypal account balance. Paypal encrypts all the data that the Buyer has communicated to him when he created his account. In this way, no data except the Buyer's email will be communicated to Publinspira, S.L.. Financial and personal data will be automatically encrypted during the sending of all sensitive information to the Paypal servers. At no time will Publinspira have access to PayPal data.
SECOND: Right of revocation and Return Policy
If the customer is not satisfied with his purchase and provided that the product is in perfect condition and has not been used, the buyer may revoke this contract within fifteen business days of receipt of the merchandise. Once the buyer's withdrawal has been communicated to the seller, the buyer must return the merchandise to the seller in the same conditions in which it was delivered. The seller, for his part, will refund the amount of the order for the fountain pens to the buyer within a maximum period of 15 days from receipt of the returned merchandise according to the carrier's delivery note.
Order revocations or merchandise returns will not be accepted outside the indicated periods.
Order revocations or merchandise returns of fountains pens modified at the customer's request will not be accepted.
Postage due shipments will not be accepted. Returned orders must include the purchase invoice, they must be in perfect condition and in their original packaging.
Used products, damaged products or products that come without their original packaging will not be reimbursed.
The withdrawal must be communicated by email to the address info@writing-pens.com within the indicated period of fifteen days. In response to this email, the buyer will receive confirmation of receipt of his decision and as much information about the return procedure as necessary (return number, shipping method and delivery address).
In the event that the product reaches the buyer in deteriorated or defective conditions, it will be exchanged for the same product in perfect condition, provided that the return periods indicated above have not passed and of course without any additional charge for the customer. Damage claims will not be accepted after 24 hours from the receipt and delivery of the merchandise.
The Buyer may cancel his order as long as it has not been shipped. If the order had left the Publinspira, S.L. warehouses, it will not be possible to cancel it, but the customer can make the return once received.
In case of change, and not return, and when the price of the sum of the products is different from that paid for the item or items to be changed, the difference will be paid with one of the means of payment specified in the first clause, when these are in favor of the seller, and through the same means of payment used by the buyer at the time of the initial order, in the event that the difference is in favor of the buyer, reducing the shipping costs of new products.
THIRD: Shipping costs, Delivery Times and Transport
1. Shipping costs:
The shipping costs of merchandise in the peninsular territory (Spain and Portugal) and in the Baleares Islands are borne by writing-pens.com from €100.00 of purchase. For orders lower than this price or that must be sent to a place other than the Peninsula and the Baleas Islands, the system will automatically calculate, in your shopping cart, the cost that the customer must pay for its reception in the indicated place.
The system will calculate this price once the customer indicates the delivery address. If the system doesn't have this information the price showed can not be the final shipping cost.

Example 1: PENINSULAR SPAIN
- Orders of €100 = FREE Shipping
- Orders less than €100 = €6.05 Shipping
Example 2: LATIN AMERICA / CENTRAL AMERICA / NORTH AMERICA
- Orders of €200 = Postage €15
- Lower orders = Postage €30

2. Delivery term:
Taking into account the type of product that is the object of the Write-pens.com website, some of the products will be in stock and other products can be served "on request". Users are encouraged to specify a delivery deadline, if one exists, or to confirm the delivery deadline before making their purchase or at the time of ordering.
If the product is in stock, the delivery time will be between 24 and 72 hours. (on weekdays)
For orders placed after 11:00 a.m. The delivery period will start counting from the next business day.
If the client chooses to pay by bank transfer, it must be taken into account that the payment takes between two and three business days to arrive.

In the event that the fountain pens are discontinued or it is not possible to replenish their stocks, the client will be notified of this fact so that, according to their own decision, they may either select a new product with similar characteristics and price, either cancel the order, in which case the possible amounts delivered will be refunded.
The merchandise will be delivered within the agreed period except in those cases in which the client requests delivery at a later date. For orders that include more than one product, the delivery date will be for the entire order.
As set forth in the Return Policy of this document, the customer may cancel their order as long as the shipment has not been made.
The delay attributable to the client by his own will or due to the impossibility of locating and contacting him through the data provided by him will not be considered non-compliance with delivery times.
Publinspira S.L. reserves the right to refuse to make a delivery or confirm the order that was not fully paid or, even having been fully paid, in the event of the existence of a previous order delivered and unpaid or with which there was an ongoing dispute.
3. Transportation:
Shipments of fountain pens are made daily from Monday to Thursday and always having specified the address with the clients, who may state their preference for a date or time range of delivery at their convenience. Writing-pens.com will indicate this preference to the carrier, it being his consideration to make the delivery within the time frame.
In the same way, writing-pens.com recommends to its clients, in case of not reaching an agreement with the transport agency on the date and time of delivery, to contact the customer service and inform about this fact so that the after sales service expedite delivery through other procedures.
The transport of the fountain pens is included in their price (from €100.00 per order and for destinations included in the Spanish and Portuguese Peninsula or the Baleares Islands) and only includes the transport of the fountain pens and their delivery at the door of the client's home. Orders whose destination is different from that indicated or below the indicated amount will be served equally, but the shipping price will be paid by the customer, whose amount will be calculated by the system taking into account the place of delivery and the price of the order. Said amount will be reported broken down in the shopping cart.
All products are insured against possible risks of transport, loss and handling. In the event of damage due to transport, the client must state this on the delivery note of the carrier. Claims for damages caused by transport after 24 hours from receipt and delivery of the merchandise will not be accepted.
Upon delivery of the merchandise, the customer will receive the corresponding delivery note. At the time of payment acceptance, the corresponding original invoice will be sent to the email address provided by the customer.
If the original invoice is not received, the client may request it by email to the address info@writing-pens.com, indicating the holder of the invoice, the corresponding order number and the e-mail address where you wish to receive it.
FOURTH: Warranty
Writing-pens.com guarantees all fountain pens that are the object of this contract, in general and for a period of 24 months (as long as the manufacturer does not indicate another guarantee period, which may not be less than 24 months) from the date of receipt of the merchandise, in the event of any manufacturing defect or non-conformity with the characteristics specified therein. For this, a period of 2 months is established from the time the client becomes aware of it to communicate it to the seller and thus be able to act on it. The guarantees may vary depending on each manufacturer, each model and according to parts and/or manufacturing materials. This information is available at writing-pens.com and it is recommended to read the warranty section of the manuals of each product according to manufacturer. The client is recognized the right to both free repair of the fountain pens object of the contract and their free replacement, price reduction or termination of the contract, if applicable. . writing-pens.com guarantees that all the fountain pens in its catalog have been manufactured in accordance with all the specifications and legal recommendations that apply to this type of item. Likewise, writing-pens.com undertakes to repair or replace during the guarantee period the defective elements or those that do not comply with the characteristics indicated in the product file, accepting in these cases only the guarantee of the repaired or replaced parts.
Under no circumstances will writing-pens.com accept any responsibility for defects or damages due to poor use of fountain pens or for the product's own wear and tear.
FIVE: Communications
The signatories of this contract, for the purposes of possible notifications in relation to it, set the address of writing-pens.com and its owner, Publinspira S.L., as the address indicated in the legal notice and, as the address of the client , the one provided by the same in the purchase form.
In the same way, the parties, waiving their own jurisdiction if any, expressly submit to the jurisdiction of the Courts and Tribunals of A Coruña, for any questions that may arise from the interpretation or breach of this contract.
SIXTH: Pricing Policy
Writing-pens.com and its owner, Publinspira S.L., unilaterally reserve the right to modify the price of the products and services offered through the website writing-pens.com. In order to guarantee the client the veracity and security in the price of the fountain pens, will be considered as such, and except for a manifest error, those in force in the advertising coinciding with the moment of the formalization of the order of the fountain pens.
Writing-pens.com reserves the right to publish the prices of its products only to registered customers, understanding that those registered are customers of plumasestilograficas.com and, therefore, may access special prices as a gift for their registration.
Publinspira, S.L. will not be obliged to supply any product at a clearly incorrect price and lower than its actual price, if the error in the price is obvious and unequivocal.
The prices on this website include VAT for those orders placed in national territory that by law must pay VAT, but exclude shipping costs, which will be added to the total amount, provided that the order is less than the amount from the which writing-pens.com takes charge of the postage.
Prices may change at any time, but the changes will not affect orders already placed under the above conditions.
